1. Agreement to these terms

These Terms and Conditions ("Terms") are an agreement between you and Earnastic ("Earnastic," "we," "us," or "our"). They cover your use of the Earnastic website and any related pages, tools or features (together, the "Service"). By creating an account or by using the Service in any way, you confirm that you have read these Terms, that you accept them, and that you accept our Privacy Policy and Cookies Policy, both of which form part of this agreement. If you don't agree with something here, please don't use the Service.

If we add a feature later, it falls under these Terms too, unless we say otherwise when we add it.

2. Words we use

• "Account" is the profile you set up to use the Service.
• "Content" is any text, image, data or other material found on the Service.
• "Your Content" is anything you submit or upload through the Service.
• "Partners" are outside companies whose sites, apps or services appear on or are linked from the Service.
• "You" is the person using the Service through an Account.

3. Who can use Earnastic

You need to be at least 18, or the age of majority where you live if that is higher. By using the Service you're telling us you meet that requirement, that nothing in the law of your country stops you from using it, and that what you give us when you register is accurate.

We may ask you to confirm your age or identity at any point. If we reasonably believe someone doesn't meet these requirements, we may pause or close their account.

4. Your account

Please give us accurate details and keep them current. Your login is yours alone. Keep your password private, because you're responsible for what happens under your account, including anything done by someone who got hold of your login. If you think someone else has been in your account, tell us straight away and we'll help you secure it.

One person should have one account. You shouldn't share an account, hand it to someone else, or open several to get around a limit, unless we've agreed to it in writing.

5. What Earnastic is

Earnastic is a website that gathers newer apps, games and online services in one list so that members can browse them and open the ones that interest them. The list, the layout and the features will change as we add, adjust and retire things. We can't promise that any particular entry or feature will be around for good.

6. How we ask you to behave

Please use the Service lawfully and in a way that leaves it working for everyone else. In particular, don't:

• break any law or regulation that applies to you or to us;
• try to disrupt, overload or get around the security of the Service or its servers;
• copy, reverse engineer or try to extract the source code of the Service;
• use bots, scrapers or other automated tools beyond ordinary personal use;
• open extra accounts to avoid a limit or a decision we've made about an account;
• submit anything that is unlawful, abusive, harassing, hateful or deceptive;
• pretend to be another person or organisation;
• try to reach someone else's account or any non-public part of the Service.

If we suspect a breach, we may look into it and respond as we think fit. That can include removing content, pausing an account, or telling the authorities where the law requires it.

7. What you submit

Your Content stays yours. When you submit it, you give Earnastic a limited, worldwide, non-exclusive, royalty-free licence to store, copy and display it, but only as far as needed to run, maintain and improve the Service. That licence ends when you delete the Content or close your account, apart from copies we have to keep for legal, security or backup reasons.

You're responsible for Your Content. By submitting it you confirm that you have the right to do so and that it doesn't infringe anyone else's rights.

8. What belongs to us

The Service, including its design, layout, graphics, interface and software, belongs to Earnastic or the people who license it to us, and is protected by copyright, trademark and other laws. These Terms let you use the Service as intended and nothing more. They don't pass any ownership to you.

The Earnastic name and logo are our marks. Please don't use them without asking us first.

9. Other people's sites and services

Parts of the Service lead to, or work with, sites and services run by Partners. We don't own or control those and we aren't responsible for their content, rules or practices. Anything you do with a Partner is between you and them, so it's worth reading their terms and privacy policy before you go ahead.

10. Features and promotions

From time to time we may run promotions or add optional features. They're offered at our discretion, may be limited in time or number, and can be changed, corrected or withdrawn. If something is applied to an account by mistake, or as a result of misuse of the Service, we may correct or reverse it.

11. Changes and downtime

We try to keep the Service running smoothly, but we can't promise it will always be available or free of errors. Maintenance, technical faults and events outside our control can interrupt it. We may change, pause or stop any part of the Service, temporarily or permanently, with or without notice.

12. Ending an account

You can close your account whenever you like by writing to our support address. We may pause or close an account if we reasonably believe these Terms have been broken, if the account has been used for abuse, or if that's needed to protect the Service, other members or third parties. Parts of these Terms that are meant to continue after an account ends, such as those on ownership, disclaimers and limits on liability, will continue.

13. The service as it is

The Service is provided "as is" and "as available," with no warranties of any kind, whether express, implied or statutory. To the fullest extent the law allows, Earnastic disclaims all implied warranties, including those of merchantability, fitness for a particular purpose, title and non-infringement. We don't warrant that the Service will be uninterrupted or secure, or that it will be free of errors.

14. Limits on our responsibility

To the fullest extent the law allows, Earnastic and its officers, employees and affiliates are not liable for indirect, incidental, special, consequential or punitive damages, or for lost data or goodwill, arising from your use of, or inability to use, the Service, even if we were told such damage was possible. Our total liability for any claim connected to these Terms or the Service is limited to the fees, if any, we charged you in the twelve months before the claim arose.

15. If a claim is made against us

You agree to cover Earnastic and its officers, employees and affiliates against any claim, loss or expense, including reasonable legal fees, that comes from your use of the Service, from Your Content, or from your breach of these Terms or of anyone else's rights.

16. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. Any dispute connected to these Terms or the Service must be brought in the state or federal courts located in California, and you agree to those courts having jurisdiction over you.

17. Updates to these terms

We may revise these Terms to reflect changes to the Service, the law or the way we work. When we do, we'll change the "Last updated" date at the top and, for significant changes, take reasonable steps to let you know. If you keep using the Service after the new version takes effect, that counts as accepting it.

18. Everything else

If a part of these Terms turns out to be unenforceable, the rest still applies. If we don't enforce a right straight away, we haven't given it up. These Terms, with the Privacy Policy and Cookies Policy, are the whole agreement between you and Earnastic about the Service and replace anything agreed earlier.
